1 INTRODUCTION

Welcome to the Anne Frank Trust website (the “Website”). These Terms and Conditions govern your use of the Website and your relationship with The Anne Frank Trust (“we”, “our” or “us”). Please read them carefully as they affect your rights and liabilities under the law. If you continue to browse and use this Website you are agreeing to comply with and be bound by these Terms and Conditions, which together with our privacy policy govern the Anne Frank Trust's relationship with you in relation to this Website.

This Website is owned and operated by the Anne Frank Trust UK, a registered charity (no. 02612141), a company registered in England and Wales (no. 1003279) and a registered charity in Scotland (SC040488) whose registered address is Star House, 104-108 Grafton Road, London, NW5 4BA

The Anne Frank Trust is regulated by The Charity Commission and the Scottish Charity Regulator (OSCR).

2 AMENDMENTS

The Anne Frank Trust may modify these Terms and Conditions from time to time for legal or regulatory reasons or to allow for the proper operation of the Website. Any changes will be notified to you via a suitable announcement on the Anne Frank Trust Site. The changes will apply to the use of the Website after we have given notice. If you do not wish to accept the new Terms and Conditions you should not continue to use the Website. If you continue to use the Website after the date on which the change comes into effect, your use of the Website indicates your agreement to be bound by the new Terms and Conditions.

3 REGISTRATION

Most elements of www.annefrank.org.uk may be viewed by any visitor to the Website, however access to some services may require you to register as a member. If you register, you must ensure that the details provided by you on registration or at any time are correct or complete. You must inform us immediately of any changes to the information that you provided when registering by updating your personal details in order that we can communicate with you effectively.

4 PASSWORD AND SECURITY

If you register for certain services on the Website, you may be asked to create a password. In order to prevent fraud, you must keep this password confidential and must not disclose or share it with anyone. You will be deemed responsible for all activities that occur under your password and if you know or suspect that someone else knows your password, you should notify us by contacting the [email protected] immediately. If The Anne Frank Trust has reason to believe that there is likely to be a breach of security or misuse of the Website, we may require you to change your password or we may suspend your account.

5 EVENTS BOOKING

5.1 If paying for the tickets via invoice, payment should be made with 30 days of the invoice date.

5.2 All event tickets are non-refundable.

5.3 If an event is cancelled or rescheduled, you will be offered either to retain your ticket for the new event date or to be given a full refund.

5.4 If using a family trust or foundation to buy event tickets, guests are reminded that the purchase must be permitted by the terms of that trust or foundation.  The purchase price of a ticket is not a donation and ordinarily charitable funds should not be used to buy tickets on behalf of guests.

5.5 If the tickets are not used payment must still be made to cover the costs of the charity.

5.6 The Anne Frank Trust has the right to refuse sale of tickets to guests who have outstanding ticket payments or charitable pledges on their account.

5.7 The Anne Frank Trust has the right to refuse entry or eject any guests from an event if they are under the influence of alcohol, and a refund will not be given in these circumstances.

5.8 Guests should inform The Anne Frank Trust of any change to email, telephone, or postal address details.

5.9 Photography and filming is common at our events. By attending the event all guests consent to The Anne Frank Trust using these images and any video footage in our promotional material. If you have any objection to these when you attend the event please speak to a member of the Anne Frank Trust staff.

5.10 Requests for seating placement in a room will be considered but cannot be guaranteed.

5.11 Guests should check that all details on admit cards, tickets or confirmation emails are correct and inform The Anne Frank Trust of any errors so that these can be rectified prior to the event. Errors notified less than 48 hours prior to an event may not be corrected.

5.12 If purchasing a table for an event, a table host must inform The Anne Frank Trust of all guest names at least 48 hours prior to the event. Names received or changed after this time may not be added to the event guest list or receive a name card at the event.

5.13 The Anne Frank Trust cannot be liable in any way for the acts or omissions of others (including caterers and venue operators). However, The Anne Frank Trust does not seek to exclude its liability to guests for death or personal injury caused by its negligence, fraud or any other liability which cannot be lawfully excluded or limited.

5.14 The Anne Frank Trust may share guests’ details with other suppliers linked to the event, but only for the purpose of the event and will never share these details for any marketing purposes.

5.15 Any decision made by door staff or venue management is final.

6 TRADE MARKS AND COPYRIGHT

The content of this Website is protected by copyright, trademarks, database right and other intellectual property rights. This Website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, graphics, information, photographs, logos and names. 

You may retrieve and display the content of the Website on a computer screen, store such content in electronic form on disk (but not any server or other storage device connected to a network) or print one copy of such content for your own personal, non-commercial use, provided you keep intact all and any copyright and proprietary notices. 

You may not otherwise reproduce, modify, copy or distribute or use for commercial purposes any of the materials or content on the Website without written permission from the Anne Frank Trust. All trademarks reproduced in this Website, which are not the property of, or licensed to the operator, are acknowledged on the Website.

7 YOUR USE OF THIS WEBSITE

7.1 You may not use the Website for any of the following purposes:

7.1.1 creating a link to the Website from another website or document without the Anne Frank Trust's prior written consent;

7.1.2 disseminating any unlawful, harassing, libellous, abusive, threatening, harmful, vulgar, obscene, or otherwise objectionable material or otherwise breaching any laws;

7.1.3 transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any applicable laws, regulations or code of practice;

7.1.4 interfering with any other person's use or enjoyment of the Website; or

7.1.5 making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.

7.2 You will be responsible for our losses and costs resulting from your breach of this condition

 
8 AVAILABILITY OF THE SITE

Although every effort is made to keep the Website up and running smoothly, we cannot guarantee that the service will be fault-free. The Anne Frank Trust accepts no responsibility for and will not be liable for the Website being temporarily unavailable due to technical issues beyond our control.

9 THE ANNE FRANK TRUST'S RIGHT TO SUSPEND OR CANCEL YOUR REGISTRATION

We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these Terms and Conditions. You can cancel your registration at any time by informing us in writing at [email protected] If you do so, you must stop using the Website. The suspension or cancellation of your registration and your right to use the Website shall not affect either party's statutory rights or liabilities.

10 ANNE FRANK TRUST’S LIABILITY

10.1 The information contained in this Website is intended for information purposes only. The information is provided by The Anne Frank Trust and whilst we endeavour to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability with respect to the Website or the information, services, or related graphics contained on the Website for any purpose. Any reliance you place on such information is therefore strictly at your own risk.

10.2 From time to time this Website may also include links to other websites or resources which are beyond our control. These links are provided for your convenience only. We cannot make any warranties or guarantees in relation to such content. 

10.3 If we are in breach of these Terms & Conditions, we will only be responsible for any losses that you suffer as a result to the extent that they are a foreseeable consequence to both of us at the time you make the relevant order. Our liability shall not in any event include business losses such as lost data, lost profits or business interruption.

11 ADVERTISING AND SPONSORSHIP

Part of the Website may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on the Website complies with relevant laws and codes. We will not be responsible to you for any error or inaccuracy in advertising and sponsorship material.

12 INTERNATIONAL USE

We make no promise that materials on the Website are appropriate or available for use in locations outside the United Kingdom and accessing the Website from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Website from locations outside the United Kingdom, you do so on your own initiative and are responsible for compliance with local laws.

13 REFUND POLICY

 

 13.1 At The Anne Frank Trust we uphold the highest standards of legal and fundraising compliance.

13.2 We comply with all statutory obligations and governmental guidance in respect of refunds.

 13.3 Under charity law, we are not permitted to refund donations other than in specific circumstances. In respect of refunds in other circumstances (where not otherwise referred to in these terms and conditions) we will consider each case on its own merits and entirely at our discretion.

14 GENERAL

14.1 Your use of this Website and any dispute arising out of such use of the Website is subject to the laws of England and Wales. 

14.2 You may not transfer any of your rights under these Terms and Conditions to any other person. We may transfer our rights under these Terms and Conditions to another business where we reasonably believe your rights will not be affected.

14.3 If you breach these Terms and Conditions and The Anne Frank Trust chooses to ignore this, The Anne Frank Trust will still be entitled to use its rights and remedies at a later date or in any other situation where you breach the Terms and Conditions.

14.4 The Anne Frank Trust shall not be responsible for any breach of these Terms and Conditions caused by circumstances beyond its reasonable control.
